Acceptable Use Policy

What you can and can't do with the platform.

This Acceptable Use Policy (“AUP”) governs the use of the Text N Dial communications platform operated by Vibratel LLC. This policy is incorporated into and forms part of our Terms of Service.

1Prohibited Content

You may not use the Service to send, transmit, or facilitate any of the following:

  • ✗ Unsolicited messages (spam) to recipients who have not provided explicit opt-in consent
  • ✗ Messages containing illegal content, threats, harassment, or hate speech
  • ✗ Phishing, fraud, or deceptive communications
  • ✗ Content that violates intellectual property rights
  • ✗ Malware, viruses, or harmful code
  • ✗ Adult content or sexually explicit material
  • ✗ Cannabis, CBD, or controlled substance promotions (per carrier restrictions)
  • ✗ Loan, debt collection, or financial offers without proper licensing
  • ✗ Political campaign messages without required disclaimers

2Messaging Requirements

All SMS/MMS messaging through the Service must comply with:

TCPA

Telephone Consumer Protection Act requirements for prior express consent

10DLC Registration

All messaging must be associated with an approved 10DLC brand and campaign

Opt-Out Handling

All messages must honor STOP, UNSUBSCRIBE, and other opt-out keywords immediately

Opt-In Records

You must maintain records of consent for all message recipients

Message Content

Messages must match your registered 10DLC campaign use case

Rate Limits

You must not attempt to circumvent carrier-imposed throughput limits

3Voice Service Requirements

  • ✗ Do not use the Service for robocalling or auto-dialing without consent
  • ✗ Caller ID spoofing is prohibited except where legally permitted
  • ✗ Do not use the Service to make threatening, harassing, or fraudulent calls
  • ⚠ Call recording may be subject to one-party or two-party consent laws depending on jurisdiction — compliance is your responsibility

4System Abuse

You may not:

  • ✗ Attempt to gain unauthorized access to the Service or its infrastructure
  • ✗ Interfere with or disrupt the Service or its connected networks
  • ✗ Use the Service for denial-of-service attacks or traffic pumping
  • ✗ Reverse engineer, decompile, or attempt to extract source code
  • ✗ Share, resell, or sublicense access without authorization
  • ✗ Use automated tools to scrape or harvest data from the Service

5Consequences of Violation

Violations of this AUP may result in:

Warning

Request to cease the violating activity

Suspension

Temporary suspension of messaging or voice capabilities

Termination

Permanent account termination without refund

Legal Action

Reporting to law enforcement if required by law

We reserve the right to determine what constitutes a violation at our sole discretion.
